1. Introduction
These General Terms and Conditions (“Terms”) govern the use of services offered by Ramirez Adventures & Rentals, a family-owned tourism and car rental company operating on the island of Roatán, Honduras (“the Company”, “we”, “us”, or “our”). By booking any tour, activity, or rental vehicle through our website, phone, email, or in-person, you (“Client”, “Guest”, “you”) agree to be bound by these Terms in their entirety.
Please read these Terms carefully before making any booking. If you do not agree with any part of these Terms, please do not proceed with a booking.
2. Bookings & Reservations
2.1 How to Book
Reservations can be made through our website at www.ramirezadventures.com, by phone at +1 888-702-5508, or by email at ramirezadventuresandrentals@gmail.com. A booking is confirmed only upon receipt of a written confirmation from Ramirez Adventures & Rentals.
2.2 Booking Confirmation
Upon confirmation of your booking, you will receive a confirmation email with the details of your reservation, including tour name, date, time, meeting point, and total price. It is your responsibility to verify that all details are correct.
2.3 Minimum Participants
Certain tours require a minimum number of participants to operate. We reserve the right to cancel or reschedule a tour if the minimum number of participants is not met. In such cases, a full refund or alternative date will be offered.
3. Pricing & Payment
3.1 Prices
All prices are listed in US Dollars (USD) unless otherwise stated. Prices are per person unless explicitly stated otherwise. Prices are subject to change without prior notice until a booking is confirmed.
3.2 What Is Included
Each tour description clearly states what is included in the price (e.g., transport, entrance fees, equipment, meals). Anything not explicitly listed as included is not part of the package.
3.3 Deposit & Full Payment
A deposit may be required to secure your reservation. Full payment is typically required prior to or on the day of the tour or rental. We accept cash (USD), and credit/debit card payments where available.
3.4 Additional Costs
Clients are responsible for any personal expenses, gratuities, souvenirs, food or beverages not included in the tour package, and any costs arising from personal decisions made during the tour.
4. Cancellations & Refunds
4.1 Cancellation by Client
• Cancellations made 72 hours or more before the scheduled tour or rental start time: full refund.
• Cancellations made between 24 and 72 hours before start time: 50% refund.
• Cancellations made less than 24 hours before start time: no refund.
• No-shows on the day of the tour or rental: no refund.
4.2 Cancellation by the Company
Ramirez Adventures & Rentals reserves the right to cancel any tour or rental due to adverse weather conditions, insufficient participants, force majeure, or any other circumstances beyond our control. In such cases, clients will be offered a full refund or the option to rebook on an alternative date.
4.3 Refund Processing
Approved refunds will be processed within 7–10 business days. Refunds are issued using the same payment method originally used.
5. Health, Safety & Conduct
5.1 Physical Requirements
Some tours involve physical activity. It is the client’s responsibility to assess whether they are physically capable of participating in the chosen activity. We recommend consulting a physician if you have any health concerns.
5.2 Medical Conditions
Clients must inform us of any medical conditions, disabilities, allergies, or special requirements at the time of booking. We reserve the right to refuse participation if we believe it may jeopardize the safety of the client or others.
5.3 Alcohol & Substances
Clients under the influence of alcohol or any controlled substance may be refused participation without refund.
5.4 Conduct
Clients are expected to behave respectfully toward guides, staff, other participants, local communities, and wildlife. We reserve the right to remove any client from a tour or activity for disruptive or unsafe behavior without refund.
5.5 Children
Minors under 18 must be accompanied by a parent or legal guardian. The accompanying adult assumes full responsibility for the minor throughout the activity.
6. Liability & Assumption of Risk
6.1 Inherent Risks
Adventure tourism and outdoor activities involve inherent risks that cannot be completely eliminated, including but not limited to: slips, falls, animal encounters, sea conditions, and weather events. By booking, clients acknowledge these risks.
6.2 Limitation of Liability
Ramirez Adventures & Rentals, its owners, employees, guides, and agents shall not be liable for any personal injury, death, property damage, or loss arising from participation in any tour or use of a rental vehicle, except where such liability cannot be excluded by law.
6.3 Insurance
We strongly recommend that all clients purchase comprehensive travel insurance that includes coverage for adventure activities, medical emergencies, trip cancellations, and personal liability before traveling to Roatán.
6.4 Indemnification
Clients agree to indemnify and hold harmless Ramirez Adventures & Rentals from any claims, damages, losses, or expenses arising out of their breach of these Terms or their negligent or wrongful conduct during a tour or rental.
7. Car Rental Specific Terms
7.1 Driver Requirements
• Valid driver’s license from your country of residence.
• Minimum age: 21 years old (25+ recommended for certain vehicles).
• A valid credit or debit card in the primary driver’s name.
7.2 Vehicle Use
Rental vehicles must be used only on paved or approved roads on Roatán Island. Off-road use is not permitted unless explicitly authorized for specific 4×4 vehicles. Vehicles must not be used for transporting goods for commercial purposes.
7.3 Fuel Policy
Vehicles are provided with a full tank of fuel. Clients are responsible for returning the vehicle with the same level of fuel. Failure to do so will result in a fuel surcharge.
7.4 Damage & Deductible
Clients are responsible for any damage to the vehicle during the rental period. A pre-rental inspection will be conducted and documented. Any damage not noted on the inspection form at the time of pickup is the client’s responsibility.
7.5 Traffic Violations
Clients are solely responsible for any traffic violations, parking fines, or road tolls incurred during the rental period.
8. Intellectual Property
All content on the Ramirez Adventures & Rentals website, including text, images, logos, and graphic elements, is the exclusive property of Ramirez Adventures & Rentals or its licensors and is protected by applicable copyright and intellectual property laws. No content may be reproduced, distributed, or used without prior written permission.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Honduras. Any disputes arising from these Terms or the services provided shall be subject to the exclusive jurisdiction of the courts of Honduras.
10. Modifications to These Terms
Ramirez Adventures & Rentals reserves the right to modify these Terms at any time. Updated Terms will be published on our website with the date of the last revision. Continued use of our services after any modification constitutes acceptance of the new Terms.
